While the testimonial devices of trial used in rulemaking have received an inordinate amount of attention, little consideration has been given to the information gathering mechanisms of the judicial process. These mechanisms are traditionally combined under the term discovery. This Article will discuss those mechanisms usually associated with discovery as they may relate to the rulemaking function.
